Terms of Services

These Terms of Service ("Terms") are an agreement between you and Zenfusion, LLC, a Wyoming limited liability company ("Zenfusion," "we," "us"). They govern your use of zenfusion.com, the Zenfusion: AI SEO + AEO Pages app for Shopify (the "App"), and our managed SEO and AEO services (together, the "Services"). By installing the App, purchasing a plan, or using the Services, you agree to these Terms and to our Privacy Policy.

If you are using the Services on behalf of a business, you confirm you have authority to bind that business, and "you" means the business.

1. What Zenfusion does

The App generates pages and blog posts from your Shopify catalog using AI, and publishes them to your store through Shopify's APIs. The managed service is a separate offering, delivered by the Zenfusion team under a separate order or statement of work. Managed-service engagements are governed by these Terms plus the terms of that order; where they conflict, the order controls.

2. Eligibility and your account

You must be at least 18 and operate a Shopify store to use the App. The App runs inside your Shopify admin under your Shopify account; there is no separate Zenfusion login. You are responsible for everyone who accesses the App through your store's staff accounts.

3. Plans, credits, and billing

  • Plans. The App offers a free plan and paid monthly plans. Current plans, credit allowances, and prices are shown in the Shopify App Store listing and inside the App. We may change plans and prices with notice; changes take effect at your next billing cycle.

  • Credits. One credit generates one page or post. Credits included in a plan are added each billing cycle. Free-plan credits reset monthly and do not carry over. Credits on paid plans roll over and expire six months after they are issued, oldest first.

  • Additional credits. You may buy additional credits inside the App at any time. Purchased credits follow the same six-month expiry.

  • Billing through Shopify. All App charges, including plan subscriptions and credit purchases, are billed through Shopify's Billing API and appear on your Shopify invoice. Shopify's payment terms apply to those charges. We do not collect your payment details.

  • Upgrades, downgrades, and cancellation. You can change or cancel your plan inside the App at any time without contacting us. Upgrades take effect immediately. Downgrades and cancellations take effect at the end of the current billing cycle; you keep access to paid features until then. Uninstalling the App cancels your subscription.

  • Refunds. Subscription fees are not refunded for partial billing periods. Credit purchases are final and non-refundable. If you believe you were charged in error, contact us within 30 days and we will review it.

  • Managed services are billed monthly through Stripe under the terms of your order. There are no long-term contracts; you may cancel with notice before your next billing date.

4. Your content and generated content

  • Your inputs. You keep all rights to your store data, catalog, images, and anything you enter into the App. You grant us a license to use them only to provide the Services to you.

  • Generated content. As between you and Zenfusion, you own the pages and posts the App generates for your store. You may edit, publish, and delete them freely. They are published to your store and remain there whether or not you keep using the App.

  • Your responsibility. AI-generated content can contain errors, outdated information, or statements that don't fit your products or your legal obligations. You are responsible for reviewing content before and after publishing it, and for what you publish on your store, including compliance with advertising, consumer-protection, and industry rules that apply to you.

  • Third-party material. Images from Pexels and Pixabay, YouTube embeds, and Loox reviews are provided under those services' own terms and licenses. You are responsible for using them within those terms.

5. Acceptable use

You agree not to use the Services to:

  • generate or publish content that is unlawful, deceptive, defamatory, infringing, or that makes health, financial, or safety claims you cannot substantiate;
  • violate Shopify's terms, Google's or any search engine's guidelines, or any third party's rights;
  • interfere with, reverse engineer, or attempt to access the App or its infrastructure beyond its intended interface;
  • resell or share your plan, credits, or access with stores you don't operate, unless we've agreed to that in writing (agencies, contact us).

We may suspend or terminate access for violations of these Terms.

6. Search and AI visibility

The App structures content for search engines and AI answer engines. Zenfusion does not control Google, ChatGPT, Perplexity, or any other third-party platform and makes no guarantee that any page will rank, be indexed, be cited, or generate traffic or sales. Results depend on factors outside the App, including your store, your market, and third-party algorithms that change without notice.

7. Our intellectual property

The App, its software, design, workflows, and brand are owned by Zenfusion and protected by intellectual property law. These Terms give you a limited, non-exclusive, non-transferable right to use the App for your store while your plan is active. Nothing here transfers ownership of the App to you.

8. Shopify and third-party services

The App depends on Shopify's platform and APIs. Your use of Shopify is governed by Shopify's terms. We are not responsible for changes, outages, or limitations in Shopify or in any third-party service the App connects to (AI providers, image libraries, YouTube, Loox). If a third-party change affects the App, we will work to restore functionality but cannot guarantee it.

9. Availability, support, and changes

We aim to keep the App available at all times but do not guarantee uninterrupted service. We may update, add, or remove features. Support is available by email at success@zenfusion.com, and we respond as quickly as we can during business hours.

10. Termination

You may stop using the Services at any time by cancelling your plan or uninstalling the App. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Services with reasonable notice. On termination, unused credits are forfeited, and we delete your App data as described in our Privacy Policy. Content already published to your store stays in your store.

11. Disclaimer of warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, ZENFUSION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT GENERATED CONTENT WILL BE ACCURATE, ERROR-FREE, OR ACHIEVE ANY PARTICULAR RESULT.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ZENFUSION WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES. ZENFUSION'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

13. Indemnification

You agree to defend and indemnify Zenfusion and its members, officers, and contractors from claims, damages, and expenses (including reasonable legal fees) arising from content you publish using the Services, your use of the Services in violation of these Terms, or your violation of any law or third-party right.

14. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Services will be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction. Disputes will be resolved on an individual basis; you agree not to bring or participate in a class or representative action. Before filing a claim, you agree to contact us at success@zenfusion.com and give us 30 days to try to resolve it informally.

15. Changes to these Terms

We may update these Terms as the Services evolve. We will post the updated version here with a new effective date and, for material changes, notify you by email or inside the App. Continued use after the effective date means you accept the updated Terms.

16. General

These Terms, your order (for managed services), and our Privacy Policy are the entire agreement between you and Zenfusion about the Services. If any provision is found unenforceable, the rest remain in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce a provision is not a waiver of it.
